TERMS OF SERVICE

Terms of Service

These Terms of Service (the "Terms") set forth the conditions for using "simrip" (the "Service") provided by simrip ("we," "us," or "our"). Users of the Service ("users" or "you") must use the Service after agreeing to these Terms.

Article 1. Service Details

The Service is an application that lets users create and manage travel guides, itineraries, packing lists, reservation information, and similar travel information, and save or share them as images or PDFs. It also provides the paid "Collaboration" feature, which allows selected trip data to be shared, synchronized, and edited with family, friends, and other invitees.

Regular trip data is generally stored on the user's device. When a user starts or uses Collaboration, trip data required for synchronization, cover images, images or PDFs selected for sharing, and other relevant information are sent to and stored on our servers.

Advertisements may be displayed in the Service. We also provide a one-time in-app purchase to remove advertisements.

Article 2. Intellectual Property Rights

All intellectual property rights related to the Service, including programs, designs, UI, logos, text, and other materials, belong to us or the lawful rights holders.

Users may not reproduce, reprint, sell, redistribute, or conduct similar acts with the contents of the Service beyond the scope of private use.

Article 3. Use of the App Store

When using the Service, users must comply with the terms of use and guidelines established by Apple.

Article 4. In-App Purchases

The Service provides ad removal as a one-time non-consumable in-app purchase and Collaboration as an in-app purchase for one trip. Neither product is an auto-renewing subscription.

In the Japanese App Store, ad removal costs ¥500 including tax and Collaboration costs ¥500 including tax per trip. The actual sales price is the price shown on the App Store purchase screen and may vary by region, currency, tax rules, or App Store price changes.

Purchases are made through the App Store. Payment, purchase approval, purchase history, refunds, and related matters are handled according to Apple's terms.

Article 5. Returns and Refunds

Due to the nature of digital content, returns, refunds, and cancellations for customer convenience are not available after purchase.

Refunds are subject to Apple's refund policy.

Article 6. Collaboration Terms

Collaboration is available for one trip selected by the purchaser until that trip's end date. The purchaser becomes the owner of the trip, and invited participants may join without making an additional purchase. A trip may have up to ten participants, including the owner.

Collaboration remains available through the trip's end date. After that date, new joins, synchronization, and editing are unavailable. The owner may end Collaboration before the trip's end date. Starting it again for the same trip after it has ended, or using it for another trip, requires a new purchase. No prorated or unused-period refund is provided if Collaboration is ended early, a participant leaves or is removed, or the trip is deleted, except where a refund is approved under Apple's refund policy.

The owner may issue or disable invite links, change or revoke participant permissions, and end Collaboration. Participants may view, edit, or check packing items according to their assigned role. Each user acknowledges that legitimate edits, deletions, and permission changes by other participants may be reflected on the user's device.

Invite links contain information required to join. Users must share invite links only with intended participants and take reasonable care to prevent unintended forwarding, public disclosure, or leakage.

Collaboration requires an internet connection. Network conditions, device state, maintenance, outages, or simultaneous editing may cause delays, conflicts, unavailability, or data inconsistencies.

Article 7. Prohibited Conduct

Users must not engage in any of the following acts when using the Service.

  • Acts that violate laws or public order and morals
  • Criminal acts or acts related to criminal acts
  • Acts that infringe intellectual property rights or other rights of the Service or third parties
  • Acts that interfere with operation of the Service
  • Unauthorized access or attempted unauthorized access
  • Improperly obtaining, using, disclosing, or transferring invite links, authentication information, or another user's permissions
  • Placing an excessive load on the Service or using automated means to access it beyond normal use
  • Attempting to analyze, reverse engineer, modify, or bypass security features of the Service
  • Unauthorized commercial use of the Service
  • Any other acts that we deem inappropriate

Article 8. Information Entered or Shared by Users

Users are responsible for itineraries, notes, reservation information, and other content they enter into the Service.

Before entering or sharing a third party's personal information, reservation number, contact information, image, or other information with participants, users must obtain any authority or consent required to handle and share it. Users must not enter or share content that infringes third-party rights, is illegal, or violates public order and morals.

Rights in content entered by users remain with the user or lawful rights holder. Users grant us permission to reproduce, store, transform, and transmit such content to the extent necessary to provide, synchronize, display, store, back up, secure, and troubleshoot the Service.

Article 9. Suspension of the Service

We may suspend or interrupt all or part of the Service without prior notice in the following cases.

  • When system maintenance is performed
  • When force majeure occurs, such as disasters, power outages, or communication failures
  • When we otherwise determine that providing the Service is difficult

Article 10. Usage Restrictions

If a user violates these Terms, we may restrict use of the Service without prior notice.

Article 11. Data

Regular trip data is primarily managed on the user's device. Data covered by Collaboration is also managed on our servers for synchronization and sharing. Details are set out in the Privacy Policy.

We are not responsible for loss of data due to device changes, device failure, deletion of the app, or any other reason.

Users are responsible for making backups as needed, such as by saving data as PDFs or images.

When Collaboration ends, the last content saved on the device may remain available in read-only form. The same may apply when the owner deletes the shared trip. If a participant leaves, is removed by the owner, or deletes the shared trip from the device, trip data and locally stored attachments may be deleted from that device.

Article 12. Disclaimer of Warranties and Limitation of Liability

We do not warrant the safety, accuracy, completeness, usefulness, continuity, fitness for a particular purpose, or other qualities of the Service.

Except in cases of our willful misconduct or gross negligence, we are not liable for damages arising from use of or inability to use the Service.

Except where limitation of liability is not permitted under the Consumer Contract Act or other applicable laws, our liability for damages is limited to the amount of fees paid by the user to the Service during the 12 months before the occurrence of the relevant damage.

Article 13. Changes to Service Content

We may change, add to, or terminate the content of the Service by giving prior notice to users or by announcing such changes in the app.

Article 14. Changes to these Terms

We may change these Terms as necessary.

The revised Terms take effect when they are published in the Service or by another method we deem appropriate.

Article 15. Handling of Personal Information

Information obtained through the Service is handled appropriately in accordance with the separately established Privacy Policy.

Article 16. Notices

Notices from us to users will be made by display within the Service or by another appropriate method.

Article 17. Assignment of Rights and Obligations

Users may not assign their status under these Terms or their rights and obligations under these Terms to any third party without our prior consent.

Article 18. Severability

If any provision of these Terms is found invalid or unenforceable under applicable law, the remaining provisions remain in effect.

Article 19. Governing Law and Jurisdiction

These Terms are governed by the laws of Japan.

If a dispute arises in relation to the Service, the court with jurisdiction over our location shall be the exclusive court of first instance.
